Attorney General Mayes Secures $460,000 Judgment Against Pro Source Vapes LLC for Illegal Sales of Tobacco and Nicotine Products to Minors

PHOENIX – Attorney General Kris Mayes today announced a consent judgment resolving a lawsuit against Pro Source Supply LLC, Pro Source Vapes LLC, Pro Source CBD LLC, and their owner, Timothy Kell, over the illegal sale of tobacco and nicotine products to underage consumers in Arizona.

The judgment, entered in Maricopa County Superior Court in December, requires Pro Source to pay $460,000 in restitution, civil penalties, and attorneys’ fees and to implement reforms to prevent underage access to tobacco and nicotine products at its retail locations.

Attorney General Mayes sued Pro Source in July of last year, alleging that its stores repeatedly sold tobacco and nicotine products to minors, in violation of the Arizona Consumer Fraud Act. Youth tobacco compliance inspections conducted by the Attorney General’s Office and the Arizona Department of Health Services documented unlawful sales at multiple locations.

Under the consent judgment, Pro Source must adopt strict age-verification policies, enhance employee training, use electronic ID scanning at points of sale, conduct regular independent compliance checks, and prohibit products and advertising that appeal to minors. The company is also barred from selling single cigarettes, flavored cigarillos at noncompliant locations, and products designed to resemble candy, toys, or school supplies.

“This judgment is about protecting kids and holding retailers accountable when they fail to follow the law,” said Attorney General Mayes. “More than 95 percent of adult tobacco users started before the legal age, and we know how quickly nicotine addiction can take hold. Retailers that sell these products have a legal and moral responsibility to make sure they are not putting Arizona’s youth at risk.”

The judgment requires Pro Source to appoint a compliance officer, conduct monthly unannounced compliance checks by an independent third party, and report results directly to the Attorney General’s Office.
