Attorney General Mark Brnovich Defends Arizona Taxpayers at Ninth Circuit

PHOENIX -- Today, Attorney General Mark Brnovich's Office (AGO) argued before the Ninth Circuit Court of Appeals to protect Arizona taxpayers and to push back against the Biden Administration’s unconstitutional Tax Mandate contained in the American Rescue Plan Act (ACT).

"The tax mandate is yet another outrageous federal overreach by the overbearing Biden Administration," said Arizona Attorney General Mark Brnovich. "I will always fight to preserve state sovereignty and vigorously defend hardworking taxpayers."

Attorney General Brnovich aims to protect Arizona taxpayers from the mandate, which threatens to withhold federal COVID-19 relief funding from states if they lower taxes in any way. The AGO is arguing that the U.S. Department of Treasury overstepped the bounds of its constitutional authority by implementing an unconstitutionally ambiguous mandate that restricts the sovereign taxing powers of the states.

Arizona’s lawsuit has garnered the support of twenty-two states, the U.S. Chamber of Commerce, and the National Federation of Independent Business Small Business Legal Center, and is one of at least six federal lawsuits across the country challenging the Biden Administration's Tax Mandate.
