Preliminary Injunction Obtained Against AZ Real Estate Consulting Companies

PHOENIX – Attorney General Mark Brnovich announced today his office won a Preliminary Injunction against a group of Arizona-based real estate consulting companies accused of scamming Arizona families. The Attorney General’s Office filed a Consumer Fraud Lawsuit against ProSolutions LLC, and owner, Ruben Diaz, in March of 2016. The lawsuit alleges ProSolutions and Diaz preyed on Spanish-speaking families who wanted to buy a home, acting as a home loan financing officer, and taking thousands of dollars in down payments from them. Families thought they purchased a home and later discovered they never owned the home.

After finding the State likely to succeed on the consumer fraud claims, the Court issued an order prohibiting Diaz, ProSolutions, and other named Defendants from advertising, offering, or providing services within the State of Arizona in connection with the sale, purchase, lease, or financing of real property. The order prohibits Diaz and others from initiating any action to evict or remove consumers living in real property while the order is in place. The order also requires the production of business records and prohibits the transfer of certain assets outside the United States. The Preliminary Injunction will remain in place while the consumer fraud litigation continues.
