Judge Extends Deadline for UEP Board Applications

Phoenix, AZ (Monday, August 19, 2013) – Arizona Attorney General Tom Horne is announcing that Utah Third District Judge Denise Lindberg has extended the deadline to September 30, 2013 for people wanting to apply to be on the Colorado City-related United Effort Plan (UEP) Board of Trustees. The UEP controls many of the homes, businesses and properties in the twin towns of Hildale, Utah and Colorado City, Arizona.

Judge Lindberg received 13 applications by the original July 11 deadline and received four more applications after the deadline. “This extension gives the chance for the Court to accept the late applications,” Horne said. Anyone who could not meet the initial deadline now has another opportunity to apply to ensure that more qualified individuals have that chance.”

Here are the minimum requirements to serve on the board:

  • A demonstrated ability to act independently and in the best interest of the Trust. Trustees must also meet the general requirements of Utah law regarding trustees, which include:
  • The ability to administer the trust expeditiously and in good faith;
  • The ability to fulfill a duty of loyalty to the Trust, including the ability to administer the trust solely in the interests of the beneficiaries;
  • The ability to act impartially and prudently; and if the trustee is appointed based upon special skills or expertise, the ability to use those qualities for the benefit of the Trust.

The Utah and Arizona Attorneys General asked for a special fiduciary to administer the UEP Trust in 2005 after the trustee put the trust assets in jeopardy by failing to defend against pending lawsuits. Last December the 10th Circuit Court ended years of legal disputes over the state’s control of the trust.

Applications to be considered for membership on the UEP Board of Trustees must be submitted by mail with a non-refundable $50 application fee. Applications should be addressed to: Judge Lindberg, Third District Court, 450 South State Street, Salt Lake City, UT 84114.
