Gilbert Man Indicted for Evading Taxes

(Phoenix, Ariz. – December 2, 2004)  A Gilbert man plead not guilty Wednesday to three felony counts in Maricopa County Superior Court.  John J. Vollaro was indicted by the Arizona State Grand Jury on one count of Fraudulent Schemes and Artifices, one count of Failure to Pay Tax Due and one count of Possession of Motor Fuel with Intent to Evade Taxes Due.  The indictment was issued November 17, 2004. 

The indictment alleges that Vollaro, the owner of a towing company, purchased diesel fuel that is sold to farmers, ranchers, and others for off-road use only. This diesel fuel is dyed red, and is exempt from state and federal fuel taxes.  The indictment alleges that Vollaro used the dyed diesel in his towing business’s on-road vehicles, thereby evaded payment of fuel taxes.   

If Vollaro is convicted of all charges, he faces up to 10 years in prison.  The indictments were a result of a joint investigation by the Arizona Motor Vehicle Division and the Arizona Attorney General’s Office.  Assistant Attorney General Paula Alleman is prosecuting this case.
