PHOENIX - Attorney General Mark Brnovich announced a settlement with BTW Concerts.com, LLC, an Arizona-based concert promoter involved in the cancellation of the2015 Arizona Jazz Festival. The settlement includes up to $75,000 in restitution for consumers and bans BTW Concerts.com, LLC, and related entities BTWCruises.com, LLC, and Alternatix, Inc. from promoting concerts in Arizona.
"Arizonans spent their hard-earned money to buy Jazz Fest tickets only to find out the event was canceled and the promoter wasn't going to issue refunds," said Attorney General Mark Brnovich. "Concertgoers deserve a full refund if they buy tickets to show that never hits the stage."
The Attorney General’s Office launched an investigation into the BTW Concerts after receiving numerous complaints from consumers about the cancellation of the 2015 Arizona Jazz Festival and the jazz-themed cruise Maxwell + The 7 Seas. The investigation revealed the promoters canceled both events without refunding consumers for the admission tickets they had purchased.
The Assurance of Discontinuance prohibits BTW Concerts and related companies from engaging in the “organization, promotion, advertisement, and/or sale of admission to any concerts, performances, or events in exchange for compensation."
The Attorney General’s Office will soon contact consumers who may be eligible for a refund in connection with this settlement. Anyone who purchased tickets to the 2015 Arizona Jazz Festival or Maxwell + The 7 Seas (promoted as Maxwell and the High Seas) that has not received a refund or credit card chargeback may be eligible for restitution if they submit a complaint and proof of payment to the Attorney General’s Office by August 20, 2017.
