AZAG Federalism Unit Scores 9th Circuit Victory

On Monday, May 2nd the 9th U.S. Circuit Court of Appeals in San Francisco reversed a lower court ruling, and determined that Arizona identity theft laws were not unconstitutional on their face.  The federal appeals court overturned the preliminary injunction previously issued against enforcement of the stolen identities law by Maricopa County Sheriff Joe Arpaio and Maricopa County Bill Montgomery.

Deputy Solicitor General Dominic Draye, part of the newly created Federalism Unit in the Arizona Attorney General’s Office, defended the state laws.
