Rights that Apply at the Sentencing Phase
- You have the right to have your views included
in the pre-sentence report. You may write a letter or complete a
Victim Impact Statement questionnaire (click on "Victim Impact State
Questionnaire" button on this website). Whichever format you choose
to use, to ensure your information is included in the pre-sentence
reports, you must mail your statement and any attachments to the
pre-sentence investigator at Maricopa County Adult Probation Dept.,
111 S. 3rd Ave, 6th Floor, West Court Building, Phoenix, AZ 85003,
Attn: Shani Martinez. If you would like to speak with the pre-sentence
investigator, you may contact her at (602) 506-3829.
- You have the right, upon request, to receive
a copy of the pre-sentence report, except sections that are made
confidential by law. (The defendants may also receive a copy of
the report, including any written or verbal statements you have
provided to the pre-sentence investigator.) To receive a copy of
the report, you may request it from the trustee, to whom copies
will be provided.
- You have the right to be present and heard
at sentencing; you may present evidence, information and opinions
about the offense, the defendant, the sentence, or your need for
restitution.
- If, at sentencing, the Court orders restitution
to be paid to you, you may file a restitution lien against any property
the defendant owns.
