The Civil Division’s Tax, Bankruptcy & Collection Section has an opening in Phoenix for a full-time attorney in its Tax Unit. The attorney who fills this position will initially concentrate in the property tax area. Thereafter they will be cross trained in other tax areas. The primary skills an attorney will need involve motion practice, appellate briefing and argument, discovery, and trial work. The property tax lawyers in the unit work closely with the Property Division of the Department of Revenue. The attorney will be responsible for giving advice to the Department regarding issues involving the Department’s guidelines, valuation methodology and statutory interpretation. Property tax attorneys are responsible for defending the Department’s property valuations at the State Board of Equalization and the Arizona Tax Court. These cases often involve large dollar amounts and occasionally draw interest from the media.

Because many of the issues involve statutory interpretation, constitutional challenges and technological changes within industries, a large number of cases go up on appeal. The attorneys need excellent writing skills to brief complicated issues and must be able to clearly articulate their positions. While few cases go all the way to trial, those that do are normally tried to the bench and involve expert witness testimony. Taxpayers in these cases are generally in the telecommunications, airline, electric generation, and mining industries. Most cases involving legal issues are often decided upon cross motions for summary judgment following disclosure and discovery. After a brief informal training period, the attorney will be expected to handle his/her own cases from beginning to end.

Candidates must have a minimum of 2 years legal experience. Attorneys with trial and appellate experience are preferred. Excellent writing skills are required. State and local tax knowledge is a plus, but candidates with a keen intellect can learn the unique substantive areas this position involves. Applicants must have the ability to exhibit good judgment in evaluating and analyzing diverse legal issues, and the ability to work collaboratively with others. In addition, the attorney will need some litigation experience to represent the Department of Revenue before the State Board of Tax Appeals and the Arizona Tax Court. Most cases involving legal issues are decided upon cross motions for summary judgment following disclosure and discovery. Most of the income tax and TPT tax cases involve statutory interpretation and work their way through all levels of appeal. After a brief informal training period, the attorney will be expected to handle his/her own cases from beginning to end.

Income tax issues may involve class actions at one extreme and pro per tax protesters at the other. The tax lawyers in the unit work closely with the Department of Revenue and may be asked for advice on a wide range of subjects, including proposed legislation, escheats, unclaimed property, inter-governmental agreements, administrative rules, open meeting law and lottery issues. Our cases often involve large dollar amounts and/or important issues and are litigated against the top law firms in the State. While the Arizona Department of Revenue is our main client, our cases may also affect the Departments of Commerce, Insurance, and Education.
