
Terry Goddard Announces Settlement with Dell to Refund Consumers
The Office of the Arizona Attorney General, along with similar offices in 33 other states, recently concluded an investigation into certain business practices of Dell Inc. and its subsidiary Dell Financial Services, LLC. The participating states have entered into an Assurance of Discontinuance with Dell, which is a legal agreement that has been filed with the Maricopa County Superior Court in Arizona. Dell has agreed to modify its business practices regarding financing promotions, customer service, warranties, and rebates.
Dell also has agreed to make funds available to the State of Arizona to distribute in the form of restitution to consumers who suffered a direct monetary loss as a result of certain business practices of Dell. “Restitution” includes only money you have paid, less any refunds or credits you have already received from Dell or any other source.
In order to be considered for restitution, you must mail a completed claim form to the address on the claim form [or email the completed claim form to consumerinfo@azag.gov or fax it to 602.542.4377]. To obtain a claim form, click here or call one of the telephone numbers set forth below. The completed claim form must be postmarked [or transmitted by email or fax] no later than April 13, 2009.
If we receive claims that total more than the amount of money Dell will pay to the State of Arizona to distribute as restitution, we will make a pro rata (proportional) distribution of the money, which means that you may not get a refund for the entire amount you claim you are owed. Additionally, if your claim does not qualify for restitution, we will contact you and let you know. In that situation, you can file a consumer complaint with our office, which we will attempt to resolve informally with Dell.

Please note that we expect that restitution checks will not be mailed before July 2009. Therefore it is very important that you advise this Office if you change your address after submitting your claim form.
